01.1. Agreement to Terms
These Terms and Conditions (the "Terms", "Agreement") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("Client", "you", "your"), and Ergo Setup Boston LLC, a single-member limited liability company registered in the Commonwealth of Massachusetts, doing business as ErgoAssembly ("ErgoAssembly", "we", "us", "our").
This Agreement governs your access to and use of ergoassemblyboston.com (the "Website") as well as all professional furniture assembly, setup, leveling, anchoring, and calibration services provided by us within our Massachusetts service area. By accessing the website, requesting a quote, or booking a service, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree, you must immediately cease using the website and decline our services.
02.2. Description of Services & Service Area
ErgoAssembly provides specialized, on-site ready-to-assemble assembly services for residential and commercial clients. Our primary expertise includes, but is not limited to, motorized standing desks, zero-gravity recliners, custom wardrobe systems, bedroom furniture, office systems, fitness equipment, and outdoor patio sets.
Our local operations are restricted to the Greater Boston area, including Cambridge, Somerville, Arlington, Brookline, Medford, Malden, Melrose, Woburn, Winchester, Belmont, Watertown, Waltham, Newton, Lexington, Needham, Dedham, and other neighboring municipalities in Massachusetts.
03.3. Quote Request and Veracity of Reference Materials
Clients may request flat-rate quotes by submitting forms on our website or communicating via our integrated live chat tools. To generate an accurate quote, clients are prompted to provide description text, manufacturer instructions, and/or reference photographs of the boxes, the assembly area, or the specific furniture models.
• Client Warranty: You warrant and represent that all descriptions, instructions, and photographs uploaded or sent to us are accurate, truthful, and representative of the actual items requiring assembly and the real conditions of the workspace.
• Adjustment of Quotes: Upfront quotes are based strictly on the information provided. If, upon arrival, our assembly technician determines that the furniture items differ in model, quantity, condition, or complexity from the photographs or descriptions provided, or if manufacturer manuals were withheld, we reserve the right, at our sole discretion, to: (a) adjust the flat-rate price to reflect the actual scope of work, (b) reschedule the appointment, or (c) cancel the service subject to a cancellation fee.
04.4. Workspace Readiness and Safety Requirements
For the safety of our technicians and the efficient execution of the service, the Client must comply with the following space requirements:
• Cleared Area: The Client must guarantee a clean, cleared, flat, and safe workspace prior to the technician's arrival. The cleared floor space must be at least twice the dimensions of the final assembled furniture piece to allow safe manipulation of panels and tools.
• Access and Utilities: The assembly area must have adequate lighting, ventilation, temperature control (heating/cooling), and access to functioning electrical outlets.
• Safety of Occupants: To avoid injuries and interference, all children, domestic pets, and third-party bystanders must be kept completely clear of the immediate assembly workspace at all times during the service.
• Right of Refusal: Our technicians reserve the right to refuse service and leave the premises immediately if they encounter unsafe, unsanitary, hazardous, or hostile conditions (including, but not limited to, presence of mold, pests, structural collapse risks, unrestrained aggressive animals, or verbal/physical harassment). In such instances, the service will be canceled, and the Client will be charged a flat $75 safety cancellation fee.
05.5. Cancellation and Rescheduling Policy
Scheduling specialized technicians requires operational planning. We enforce the following cancellation and rescheduling rules:
• 24-Hour Notice: Clients may cancel or reschedule a scheduled appointment without penalty by providing notice at least twenty-four (24) hours before the scheduled start time.
• Late Cancellations / Rescheduling: Cancellations or rescheduling requests made less than 24 hours prior to the appointment will be subject to a late fee of $50.
• No-Show Policy: If our technician arrives at the scheduled service address and the Client is not present, cannot be reached, or fails to provide access to the property within fifteen (15) minutes of the scheduled start time, the technician will leave. The appointment will be classified as a "No-Show," and the Client will be billed a flat fee of $75.
06.6. Payment Terms
• Timing: Payment is due in full immediately upon completion of the assembly services, prior to the technician departing the property.
• Accepted Methods: We accept credit cards, debit cards, and secure electronic bank transfers. Cash and check payments are subject to prior written approval.
• Non-Payment: In the event of non-payment upon completion, Ergo Setup Boston LLC reserves the right to pursue all legal remedies, including placing a mechanic's lien on the property where services were rendered, in accordance with Massachusetts General Laws Chapter 254.
07.7. Warranty, Insurance, and Limitations of Liability
• General Liability Insurance: Ergo Setup Boston LLC maintains active, comprehensive commercial general liability insurance protecting against accidental property damage or bodily injury resulting directly from our technicians' work.
• Workmanship Warranty: We warrant our assembly craftsmanship for a period of seven (7) calendar days following service completion. If a component fails or loosens due to assembly error within this window, we will return to repair it at no cost. Clients must report any issues in writing within this 7-day period.
• Manufacturer Defects: We are not responsible for manufacturer defects, structural material failures (such as cheap particleboard tearing under normal loads), missing components inside sealed manufacturer boxes, or incorrect instructions provided by the manufacturer.
• Mounting and Anchoring: For wall-mounted or anchored items (such as TV mounts, wardrobes, or shelving), we rely on client-provided specifications and standard wall layouts. We are not liable for damage arising from hidden in-wall hazards (wires, plumbing) not disclosed to us, or if the client requests installation on walls with pre-existing structural issues.
• Limitation of Liability: To the maximum extent permitted by Massachusetts law, the total liability of Ergo Setup Boston LLC, its officers, members, and technicians for any claims, damages, or losses shall not exceed the total amount paid by the Client for the specific service out of which the liability arose.
08.8. Dispute Resolution and Governing Law
• Governing Law: This Agreement, and all claims or disputes arising out of our services or website, shall be governed by, construed, and enforced in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
• Forum Selection: Any legal action, suit, or proceeding arising under or relating to these Terms or our services must be brought exclusively in the state or federal courts located in Boston, Massachusetts, and you hereby consent to the personal jurisdiction and venue of such courts.
09.9. Miscellaneous
• Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from this Agreement and will not affect the validity and enforceability of any remaining provisions.
• Entire Agreement: These Terms constitute the entire agreement between the Client and Ergo Setup Boston LLC regarding the services and website, superseding any prior verbal agreements or understandings.
